With the recent implementation of EPA's "Incentives for Self-Policing," these benefits have become more quantifiable. For companies following EPA's guidance and meeting specified conditions, the gravity component (the punishment portion) of a civil fine can be eliminated or substantially reduced. In addition, such cases will not be recommended for criminal prosecution. The first step in developing a compliance auditing program, is to determine your company's auditing strategy—this is key to your program's success. Because of the potential legal implications of an auditing program, Wilson suggests that your company’s legal staff be consulted in the early stages of the planning process. This helps assure that the auditing strategy meets your specific requirements up front. It is crucial that these considerations be resolved prior to performing actual audits, when the clock for EPA reporting and corrective action deadlines starts ticking. Once the strategy is defined, Wilson will review your company's compliance tools and policies, and assess your operations to gain an overview of which regulations apply. Next, we will work with you to develop a customized audit format/process that builds on your existing efforts. In developing this process, it is important to look forward to the agency reporting requirement. To remain eligible for EPA's incentives for self-policing, violations must generally be reported within 10 days of discovery and corrected within 60 days. Especially when undertaking a multi-site project, resources must be scheduled and balanced to ensure that these deadlines are not overlooked in a rush to complete the auditing phase.
